As a seasoned lvl 70 raiding hunter I can tell you a little in regards to your question. Bear with me if it gets long winded as these are types of things that earn Hunters the name
and irratate the crap out of me.
1. Although it is possible he came in to the instance with the intentions of taming a hyena as mentioned on previous post. He should have said that to the party beforehand.
True; there are some situations (especialy in high end content) where the pet is going to die allmost immediately on boss fights so it doesnt matter if
you have pet at THAT time or not. Not bringing one at all is just plain dumb imo. Especially for mid level instance like SM.
2. And probably the most likely of answers; He is just not well versed in his class/roll as was indicated by his rediculous melee antics. (Nub) I'm gonna take a streatch here and assume he probably ran out of arrows and probably had no food to feed his pet.
He probably just jumped into party and was so excited to go into instance, he didn't take stock of his invintory. That my friend; is the kiss of death. -Hunter
Druid either never tamed one, or he came unprepared. He could also have stabled it in order to tame a different pet. I think in SM you can tame one of the hyenas.-

Why
would a level 38 hunter not have a pet? I partied with one in sm-cathedral yesterday ...he also used melee attacks instead of a bow/gun. He did less damage than the other hunter (who DID have a pet and a bow), but neither came close to what my shield did (tankadin). Even our group's healer was whispering me WTF's.
I've never played a hunter. Could someone enlighten me?
